Article 1. The definitions and the definitions

1. 1. Suikerar arrangement (SARR), is located in Utrecht, The Netherlands

2. 2. Suikerarrangement.nl: the online dating service of Suiker arrangement.

3. 3. Paid Services: the portions of Sugar Arrangement accessible to Members against payment of the amount determined by Sugar Arrangement.

4.4. Membership: the agreement between the Member and Sugar Package under which the Member has access to and has the right to use Suikerararrangement.nl.

5. 5. Account: registration for the purpose of finding a suitable date;

6.6. Profile: the (personal) data of a Member who places a Member on its Account.

7. 7. Member: the natural person who has an Account on Suikerarrangement.nl;

8. 8. Content: all information placed on Suikerarrangement.nl by Sugar Arrangement, including, but not limited to text, photos, graphics, data, sound, applications, software.

9. 9. User Content: all information posted by a Member on Suikerararrangement.nl, including but not limited to personal data, text, photos, graphics and feedback.

10. 10. Member number: the administration number assigned to an Account by Suikerar arrangement.

Article 2. Access, Registration and Membership

1. 1. A Member must be at least 18 years old and fill in all mandatory fields of the registration form correctly and completely. It is not permitted to register under a different name or otherwise assume a false identity.

2. 2. Membership is individual, personal and non-transferable. It is not allowed to register as a couple.

3. 3. Sugar package is entitled to require a copy of the applicant’s identity document to check the registration.

4.4. The Membership starts as soon as Suikerarararar arrangement has confirmed it to the requester [by sending a login code and password that allows an Account to be created].

5. 5. Sugar arrangement reserves the right to refuse a request for Membership, if necessary without giving any reason.

6.6. The login code and password sent are strictly personal and confidential, and the Member must handle this carefully. More specifically, the login code and password may not be made available to third parties or made public in any way.

7. 7. The Member is fully responsible and liable for all use of his login code and password and for all actions taken through his Account.

8. 8. If and as soon as the Member suspects that his login code, password, account and/or identity is made unlawful use of his unauthorized use, he must immediately inform the Cookie Arrangement. In that case, Sugar arrangement is entitled to take all necessary measures to protect the safety of the safety of Sugar Arrangement.nl and the Member must fully cooperate with it.

9. 9. Sugar package reserves the right to change the registration requirements applicable to Suikerarrangement.nl without prior notice or to impose further conditions on the Membership of Suikerarrangement.nl.

10. 10. A Member is not permitted to create multiple Memberships or otherwise create multiple Accounts or Profiles, or to have a third party created on behalf of this Member or more Accounts or to have one or more Profiles created on behalf of this Member.

Article 3. The use of Suikerararrangement.nl

1. 1. The Suiker Arrangement’s Membership aims to find a suitable date. The information provided by the Member on his Account must be related to this purpose. It is not permitted to use an Account for other purposes, for the performance of unlawful acts, the commission of criminal offences and/or for acts that, in the opinion of Suikerararararar arrangement, are contrary to generally applicable norms and values.

2a. 2A. The Membership of Suikerarrangement.nl is at the Member’s own risk. This means that the Member itself is responsible for, among other things, the extent to which he/she provides personal information to other Members, whether or not responds to other Members’ reactions, makes his/her contact details available to other Members, whether or not to meet other Members and enters or breaks relationships with another Member.

2b. 2b. After purchasing a subscription, the member has access to all the functionality on the site. That is, reading messages, sending messages (up to 40 per 24 hours), chatting etc.

3. 3. When using Suikerarrangement.nl and any communication it sends through the facilities offered by Sugar Arrangement or on behalf of, the Member will refrain from:

a. committing infringement of (intellectual property) rights of third parties (including but not limited to copyrights, trademark rights and database rights);

b. committing (virtual) theft;

(c) the distribution of secret or confidential information;

d. the distribution of unlawful or criminal texts and/or image and sound material, including racist expressions, (child) porn, criminal data traffic, offensive expressions and so-called mail bombs;

e. doing obscene or well (suggestive) sexual statements;

f) the use of the data of other Members for purposes other than those for which it is intended, including the provision of this information to third parties or the sending of spam, chain letters or mailings of a commercial nature;

g. committing afraud of computer dissatisfuse ('hacking');

h. the destruction, damage or unusable of systems or automated working and software of others;

i. the distribution of viruses or otherwise intentionally disrupting communications or data storage;

j. provide itself through false keys, false codes and false capacities of access to the Content and/or User Content;

k. adversely (whether or not intentionally) adversely or disrupt the use of Suikerrangement.nl by other Members.

4.4. It is also not allowed Members when using Suikerarrangement.nl and any communication they send via the facilities offered by or on behalf of Sugar Arrangement:

a. a. Direct or indirect contact information such as phone numbers, street addresses, surnames, URLs, e-mail, Skype, Snapchat, KIK-, Facebook, MSN messenger addresses etc. or other personally identifiable information in a Profile;

b. to include in the Profile for contact details to other Members;

c. send more than three e-mail messages to the same Member within 24 hours, without first receiving a reply or permission from the Member concerned;

d. to publish photos of a sexual nature, youth photos, group photos, photos of or with animals, photos of or with children or photos of people other than the Member themselves on a Profile;

e. use a Profile to post as a blog, column or otherwise texts or images that are not directly or indirectly aimed at finding a date;

f. assume a false identity or pretending to be someone else;

g. g. Use Suikerarrangement.nl in any way for advertising services or products, or for any other (commercial) purpose that is not in accordance with the purpose of Suikerarrangement.nl.

5. 5. Profiles must contain honest and accurate information about the Member and should not be misleading. The information placed on a Profile must be kept up-to-date by the Member and, in the event of actual changes, to be adjusted or updated without delay.

6.6. Suikerarar arrangement is entitled to check all Profiles and is also entitled to object to the provisions of these Terms of Use without giving reasons, without prior warning or notice of default and without judicial intervention, to refuse or delete an Account, to temporarily or permanently block an Account, to temporarily or permanently deny access to Suikerarrangement.nl without giving reasons, to terminate the Member temporarily or permanently access to Suikerarrangement.nl and to terminate the Membership.

Article 4. Prices and payment terms

1. 1. All amounts are in euros and include sales tax (VAT), unless explicitly stated otherwise.

2. 2. Sugar Package reserves the right to change prices of Paid Services without prior notice. In the event of amounts due periodically, Suikerar package is entitled to adjust the applicable prices by means of written notification and subject to a period of three months. The Member is then entitled to terminate the Membership in writing within seven working days of the said notification against the date on which the price change would enter into force in the notification.

3. 3. All invoices must be paid without discount or set-off in accordance with the payment conditions stated on the invoice.

4.4. In the absence of timely payment of an amount due, the Member shall, without any notice of default being required, the Member shall owe the statutory interest on the outstanding amount from the original due date. If payment is not made even after notice of default, Suikerar arrangement is entitled to hand over the claim. In that case, in addition to the principal sum due (including increased interest), the Member is also obliged to pay full compensation of (extra) judicial collection costs, related to the collection of the claim, with a minimum of EUR 62,00 ex VAT.

5. 5. There will be no refund of amounts already paid by the Member.

Article 5. The privacy of privacy

The privacy policy of Sugar Arrangement as described in the Privacy Statement is an integral part of these terms of use.

Article 6. Intellectual property

1. 1. All (intellectual) property rights with regard to Suikerarrangement.nl, such as but not limited to, site design, design, trade names and brands and the Content of Sugar arrangement, but with the exception of the User Content, belong to Sugar Arrangement. The Member must refrain from any infringement of these rights, including the possibility of publishing, editing, reproducing, copying, copying, or otherwise (re)usually using (cous) part of the Content without the prior written consent of Suiker Arrangement.

2. 2. It is prohibited to edit, copy, duplicate or download, transmit, transmit, transmit, transmit, direct commercially use and/or distribute or distribute the services of Suikerarararararhagen in any way or to reproduce or publish in any other way.

3. 3. The Member guarantees that the User Content placed on Suikerarararastic.nl does not infringe (intellectual property) rights of third parties and indemnify Suikerar arrangement both in and out of court for all claims of third parties in this respect and for all damage (including all costs) that Suikerar arrangement suffers in connection with such claims. By uploading User Content, the Lid Suikerarar Arrangement gives the irrevocable right to publish, edit, reproduce, copy and/or otherwise (re)use this User Content in the context of the services of Sugar Arrangement without payment of any compensation to the Member. Sugar package is (for the sake of) among other things to use the photo of a Member as posted in his/her Profile in banners and other expressions such as on Facebook or in advertisements for Suikararrangement.nl.

4.4. Members are not permitted to publish, edit, reproduce, copy or otherwise (re) use by third parties published by third parties on Suikerarrangement.nl in any way, to reproduce, reproduce, copy or otherwise (re)use by third parties.

Article 7. Termination of Membership

The Membership can be terminated by the Member at any time via the website, by e-mail to helpdesk(at)suikerarrangement.nl stating your Member number/USER username. Termination of Membership does not entitle you to a refund of any amount already paid to Sugar Arrangement and does not affect any claims of Sugar Arrangement against a Member.

2. 2. Suikerar arrangement is entitled, to its own discretion, to terminate a Membership without further notice or notice and without judicial intervention with immediate effect if:

a. the Member not fulfills any of his or her obligations under these Terms of Use or otherwise, not properly or not fully;

b. the Member acts in violation of legal requirements;

c. the Member is suspected of, or convicted of committing a criminal offence;

d. the Member has been placed under guardianship, has been subject to administration, has been eligible for debt restructuring, or it is plausible that the Member cannot otherwise meet the obligations arising from the Membership;

E. e. Sugar arrangement in her opinion has received one or more well-founded complaints about the behaviour of the Member at Suikerararrangement.nl;

In the event of termination of the Membership by Sugar Package, Suikerar arrangement is entitled to immediately delete any files of the Member and to deny him further access to Suikerarrangement.nl.

3. 3. If Suikerar arrangement for a period of force majeure cannot meet its obligations towards a Member for more than one month, Suiker arrangement shall be entitled to terminate the Membership by means of a written statement or e-mail to that Member.

4.4. In case Suiker arrangement decides to cease its activities (in whole or in part) the Membership will end automatically.

5. 5. Termination of the Membership in accordance with the provisions of this paragraph never leads to any liability of Sugar Arrangement and does not affect any claim of Sugar Arrangement on the Member concerned.

Article 8. Non-compliance; liability of the Member

1. 1. In the event of non-compliance with any obligation arising from the Membership, including, but not limited to, not complying with any provision of these Terms of Use by the Member, Suikerar Arrangement shall be entitled to, without further notice and/or notice and without judicial intervention,

a. to change the Profile;

b. to temporarily block the Account;

c. to terminate the Membership;

without prejudice to the right to any compensation and/or other Suiker arrangement under these Terms of Use and/or the law.

2. 2. The Member is liable for and indemnifies Suikerararar package both in and out of court of all claims of third parties in connection with the unlawful use of his login code, password and/or Account, the consequences of the use of Suikerarrangement.nl in general and/or not to comply with any obligation by the Member of these Terms of Use or otherwise.

Article 9. No guarantee; liability of Sugar Arrangement

1. 1. Sugar package strives to maintain carefully in Suikerarrangement.nl, to keep viruses free of viruses, to make uninterrupted availability and planned maintenance to be announced in a timely manner.

2. 2. Sugar arrangement expressly does not guarantee that:

a. the Membership results in finding a (suitable) date or (successful) relationship;

b. the Content and User Content published on Suikerararrangement.nl is correct and/or complete or suitable for the purpose for which it is used;

c. the operation of Suikerarrangement.nl is error-free and will not be interrupted by malfunctions or to the extent necessary for repairs and except due to force majeure.

3. 3. User Content posted on Suikerarrangement.nl, as well as otherwise placed opinions, columns, articles, advice, communications, advertisements, offers or other information originating from the respective author(s) and/or provider(s). Sugar arrangement is not responsible for the content thereof and cannot guarantee its accuracy, completeness or usefulness.

4.4. Unless there is intent or gross negligence on the part of Suikerarar arrangement, Sugar Arrangement is not liable for (the consequences of):

a. Disruption of an existing or new relationship as a result of Membership;

b. conduct of other Members or third parties as a result of or in connection with the Membership or use of Suikerarrangement.nl;

c. use of information published on Sugarrangement.nl;

loss of a login code and/or password or for unlawful use of the Account or the identity of the Member;

e. the use by other Members and other third parties of information sent by a Member on Suikerarrangement.nl or via Suikerarrangement.nl

f. failure and/or unavailability of Suikerrangement.nl, leaking of confidential data, (electronic) malfunctions.

5. a. Any liability of Sugar Arrangement is in any case limited to direct damage to goods and up to an amount of 1,000 euros per event or series of events with one and the same cause. Suiker arrangement is never liable for indirect damage, including reputational damage, consequential damage, lost profits or loss suffered.

b. . Sugar arrangement is in no way liable for the consequences of damage intangible or materially caused as a result of physical dates and agreements made between members themselves outside the website.

(c.c.) Sugar arrangement is in no way liable for legal or tax consequences of agreements made between members outside the website to indemnify and Members, by accepting these terms of use, thereby Suikerar arrangement of such consequences.

Article 10. Final provisions

1. 1. In the event of total or partial acquisition, merger or legal division of Suikerarar arrangement, the rights and obligations arising from the Membership shall transfer to the acquiring party and the Member shall be bound to the acquiring party to fulfil its obligations arising from the Membership and these Terms of Use.

2. 2. These Terms of Use may be changed by Sugar Arrangement at any time. The amended terms and conditions are published on Suikerarrangement.nl and are then immediately applicable, including all current Memberships.

3. 3. If any provision of these Terms of Use or any agreement is found to be invalid, this will not affect the validity of the remaining provisions. Sugar arrangement will then replace (a) new provision(s), which is as close as possible to the intention of the original provision.

4.4. In all cases in which these Terms of Use do not provide, Suikerar Arrangement shall decide.

5. 5. The Membership and these Terms of Use are governed by Dutch law. Disputes between a Member and Sugar Arrangement must be brought exclusively before the competent court in Hilversum; or, at the discretion of Sugar Arrangement, with the competent court of the Member’s domicile.

I have read and understood these terms of use and agree to all terms and conditions as described.
